The city of Bainbridge Island is asking the state to reject a proposed license for a retail marijuana shop on NE Day Road.
Michael Alex Snyder and Evergreen, a Seattle-based company that previously tried to get a license for a marijuana shop in Rolling Bay, began seeking a license for a marijuana retail store at 7880 NE Day Road late last year.
In a letter sent to the Washington State Liquor Control Board, City Attorney Lisa Marshall said the proposed location of the marijuana store would put it within the 1,000-foot off-limits buffer adopted by the state that prevents marijuana businesses from locating near schools, playgrounds, libraries or public parks.
In her Dec. 17 letter, Marshall said the proposed marijuana sales shop at 7880 NE Day Road was too close to Manzanita Park.
By the city’s estimate, the pot shop would be 750 feet from the park.
Marshall noted that that while the city’s definition of “park” did not match the state’s definition of “park” — which says that parks do not include trails — local jurisdictions can place additional restrictions on locations for marijuana stores, and said Bainbridge’s definition of “park” should be used.
“The city of Bainbridge Island does not wish to ban retail sales of marijuana,” Marshall wrote, but said the city’s definition of park should be used and the retail license should not be issued.
The city also asked for a hearing if the state did not agree to the city’s objection.
The board of the Bainbridge Island Metropolitan Park & Recreation District agreed at the park commissioners’ last meeting to also oppose Snyder’s application for a pot shop near Manzanita Park.
The board said it would sign a letter supporting the city’s stance.
A parks district official said Monday the letter had not yet been finalized.
